Our world is a world of change. Children are born and grow into adults. Material possessions rust and decay with age and ultimately perish. Yet scepticism about change is as old as philosophy itself. Heraclitus, for example, argued that nothing could survive the replacement of parts, so that it is impossible to step into the same river twice. Zeno argued that motion is paradoxical, so that nothing can alter its location. Parmenides and his followers went even further, arguing that the (...) very concept of qualitative change is inconsistent. Change in any respect is impossible, they argued, as change requires difference and nothing differs from itself. Few today would accept the Eleatic conclusion that change is impossible. But the topic of change continues to be a source of much debate, as it brings together various issues that are central to metaphysics, language, and logic – including identity, persistence, time, tense, and temporal logic. The patient preference predictor is a proposed computer-based algorithm that would predict the treatment preferences of decisionally incapacitated patients. Incorporation of a PPP into the decision-making process has the potential to improve implementation of the substituted judgement standard by providing more accurate predictions of patients’ treatment preferences than reliance on surrogates alone. Yet, critics argue that methods for making treatment decisions for incapacitated patients should be judged on a number of factors beyond simply providing them with the treatments they would (...) have chosen for themselves. These factors include the extent to which the decision-making process recognises patients’ freedom to choose and relies on evidence the patient themselves would take into account when making treatment decisions. These critics conclude that use of a PPP should be rejected on the grounds that it is inconsistent with these factors, especially as they relate to proper respect for patient autonomy. In this paper, we review and evaluate these criticisms. We argue that they do not provide reason to reject use of a PPP, thus supporting efforts to develop a full-scale PPP and to evaluate it in practice. There are no data in this work. (shrink)

In an earlier paper in these pages (2008), we explored the puzzling link between dispositions and conditionals. First, we rehearsed the standard counterexamples to the simple conditional analysis and the refined conditional analysis defended by David Lewis. Second, we attacked a tempting response to these counterexamples: what we called the ‘getting specific strategy’. Third, we presented a series of structural considerations that pose problems for many attempts to understand the link between dispositions and conditionals. Finally, we developed our own (...) account of this link, which avoids all of the standard counterexamples and comports with the relevant structural considerations. The recent publication by Wylie et al. is reviewed, demonstrating that the p53 protein regulates the movement of transposons. While this work presents genetic evidence for a piRNA‐mediated p53 interaction with transposons in Drosophila and zebrafish, it is herein placed in the context of a decade or so of additional work that demonstrated a role for p53 in regulating transposons and other repetitive elements. The line of thought in those studies began with the observation that transposons damage DNA and p53 (...) regulates DNA damage. The presence of transposon movement can increase the rate of evolution in the germ line and alter genes involved in signal transduction pathways. Transposition can also play an important role in cancers where the p53 gene function is often mutated. This is particularly interesting as recent work has shown that de‐repression of repetitive elements in cancer has important consequences for the immune system and tumor microenvironment. (shrink)

In her latest writing on the trolley problem, 'Turning the Trolley,' Judith Jarvis Thomson defends the following counter-intuitive position: if confronted with a choice of allowing a trolley to hit and kill five innocent people on the track straight ahead, or turning it onto one innocent person on a side-track, a bystander must allow it to hit the five straight ahead. In contrast, Thomson claims, the driver of the trolley has a duty to turn it from the five onto the (...) one. Thomson’s argument is fundamentally flawed in several important ways. We explain her argument and identify its major flaws. Our aims are: (a) to show that Thomson has not provided reason to think such an act is not permissible, and (b) to use the process of exposing the weaknesses in different parts of her argument to demonstrate the importance of undertaking what we call a Hohfeldian analysis of the 'mechanics' of the rights in play. A Hohfeldian 'mechanics' of rights extends the distinctions that Hohfeld first introduced to take into account the pro tanto normative 'forces' at work on an agent, the balance of which determines who in the end has what kind of right. This is the introduction to the Ashgate volume on Rawls in their history of political thought series. It puts Rawls's life and work in context and then discusses the essays included in the volume, essays of high quality likely to shape scholarship on Rawls for the coming decades.

Advancements in novel neurotechnologies, such as brain computer interfaces and neuromodulatory devices such as deep brain stimulators, will have profound implications for society and human rights. While these technologies are improving the diagnosis and treatment of mental and neurological diseases, they can also alter individual agency and estrange those using neurotechnologies from their sense of self, challenging basic notions of what it means to be human. As an international coalition of interdisciplinary scholars and practitioners, we examine these challenges and make (...) recommendations to mitigate negative consequences that could arise from the unregulated development or application of novel neurotechnologies. We explore potential ethical challenges in four key areas: identity and agency, privacy, bias, and enhancement. To address them, we propose democratic and inclusive summits to establish globally-coordinated ethical and societal guidelines for neurotechnology development and application, new measures, including “Neurorights,” for data privacy, security, and consent to empower neurotechnology users’ control over their data, new methods of identifying and preventing bias, and the adoption of public guidelines for safe and equitable distribution of neurotechnological devices. In this review essay, I first set out and then subject to criticism the main claims advanced by William Talbott in his excellent recent book, “Which Rights Should be Universal?”. Talbott offers a conception of basic universal human rights as the minimally necessary and sufficient conditions to political legitimacy. I argue that his conception is at once too robustly liberal and democratic and too inattentive to key features of the rule of law to play this role. I suggest that John (...) Rawls’s conception of human rights comes closer to hitting the mark Talbott sets for himself and that Talbott incorrectly rejects Rawls’s view. I conclude that what likely divides Talbott and Rawls is that Rawls, but not Talbott, explicitly frames the inquiry into the minimally necessary and sufficient conditions to political legitimacy in terms of a liberal democratic people attempting to determine, as a matter of its just foreign policy, whether or not to recognize other organized polities as independent and self-determining within the international order. If stem cell-based therapies are developed, we will likely confront a difficult problem of justice: for biological reasons alone, the new therapies might benefit only a limited range of patients. In fact, they might benefit primarily white Americans, thereby exacerbating long-standing differences in health and health care.

How are group-based identities related to intergroup conflict? When and how do ethnic, religious, and national identities lead to oppression, violence, rebellion, war, mass-murder, and genocide? The arts of rule cover the exercise of power by princes and popular sovereigns, but they range beyond the domain of government itself, extending to civil associations, political parties, and religious institutions. Making full use of political philosophy from a range of backgrounds, this festschrift for Harvey Mansfield recognizes that although the arts of rule are comprehensive, the best government is a limited one.

We present a new modeling framework for recognition memory and repetition priming based on signal detection theory. We use this framework to specify and test the predictions of 4 models: (a) a single-system (SS) model, in which one continuous memory signal drives recognition and priming; (b) a multiple-systems-1 (MS1) model, in which completely independent memory signals (such as explicit and implicit memory) drive recognition and priming; (c) a multiple-systems-2 (MS2) model, in which there are also 2 memory signals, but some (...) degree of dependence is allowed between these 2 signals (and this model subsumes the SS and MS1 models as special cases); and (d) a dual-process signal detection (DPSD1) model, 1 possible extension of a dual-process theory of recognition (Yonelinas, 1994) to priming, in which a signal detection model is augmented by an independent recollection process. The predictions of the models are tested in a continuous-identification-with-recognition paradigm in both normal adults (Experiments 1–3) and amnesic individuals (using data from Conroy, Hopkins, & Squire,2005). The SS model predicted numerous results in advance. These were not predicted by the MS1 model, though could be accommodated by the more flexible MS2 model. Importantly, measures of overall model fit favored the SS model over the others. These results illustrate a new, formal approach to testing theories of explicit and implicit memory. (shrink)

Contemporary Materialism brings together the best recent work on materialism from many of our leading contemporary philosophers. This is the first comprehensive reader on the subject. The majority of philosophers and scientists today hold the view that all phenomena are physical, as a result materialism or 'physicalism' is now the dominant ontology in a wide range of fields. Surprisingly no single book, until now, has collected the key investigations into materialism, to reflect the impact it has had on current thinking (...) in metaphysics, philosophy of mind and the theory of value. The classic papers in this collection chart contemporary problems, positions and themes in materialism. At the invitation of the editors, many of the papers have been specially up-dated for this collection: follow-on pieces written by the contributors enable them to appraise the original paper and assess developments since the work was first published. The present collection of essays was designed by translator David Lachterman to provide the reader with a better understanding of Scheler’s major work, Formalism in Ethics and Non-formal Ethics of Values, which will also be published in translation by Northwestern University Press. Lachterman provides us with an illuminating preface which sketches the general character of Scheler’s thought, particularly its relationship to Husserl and Heidegger, and which discusses each of the five selections. Four of the five essays presented here are (...) incomplete works, and three were never published in Scheler’s lifetime. The first, "The Idols of Self-Knowledge," is an attempt to differentiate psychical and physical phenomena and criticizes the way Brentano went about making this distinction. In "Ordo amoris" Scheler maintains with Augustine and Pascal, the priority of love over cognition. In "Phenomenology and the Theory Cognition," Scheler develops his own account of the phenomenological method. "The Theory of the Three Facts" represents Scheler’s views on the distinction between phenomenological, scientific and common sense "facts." The last essay is entitled "Idealism and Realism" and demonstrates "that it is a mistake to opt for either one of the parties to this conflict," and argues instead for a phenomenology of essences. The last section of this text, which was to be a confrontation of Scheler with the then recently published Being and Time, never appeared but is still awaiting publication in the critical edition of Scheler’s works. One welcomes Prof. Lachterman’s initiative in making available to the English reader these essays of one of the most significant figures in twentieth century German philosophy.—J. D. C. (shrink)

David Hoy’s book is a readable and generally clear introduction to the work of Hans-Georg Gadamer and to the contemporary debate surrounding Gadamer’s contribution to the theory of interpretation. Hoy begins with a chapter on a work familiar to American readers and antithetical to Gadamer—E. D. Hirsch’s Validity in Interpretation. Hirsch is shown to be in some respects a follower of the hermeneutics of Schliermacher and Dilthey in that his defense of authorial intention approximates the "empathy" of nineteenth-century hermeneutics. (...) Hoy makes a careful analysis of the problems involved in Hirsch’s distinction between "meaning"—"the meaning of [an author’s] utterance is the meaning he wills to convey" —and significance—the relation between meaning and some other, extra-textual, element or system. Hoy properly questions the view of language inherent in Hirsch’s contention that verbal meaning is entirely determined by an individual will. He notes that Hirsch neglects meaning determined by the semantics of units of text larger than the sentence. Hoy also argues persuasively that Hirsch’s claim to base his meaning/significance distinction in Frege’s opposition between Sinn and Bedeutung constitutes a misreading of Frege, and shows an ambiguity in Hirsch’s conception of the author, sometimes presented as an historical being with a will and intention and at others as the equivalent of the persona or dramatic speaker of the New Critics. Everyman’s Library commemorates its fiftieth anniversary very aptly with this issue as its thousandth volume of a classic text of some 2,300 years of age, which through varying fortunes has been a major influence in European culture. As a transcendental science Metaphysics makes no concession to the semi-curious; Aristotle’s inaugurating textbook is understandably concentrated and obscure. A literal version of this formidable text would have no appeal to the general reader, innocent largely of the Greek idiom and of philosophical jargon, (...) while a personal paraphrase could not carry the authentic voice of a past master. Mr. Warrington simply takes the existing Oxford version, retranslating it into easier, more fluent English and rearranging its fourteen books into a free, logical order. In this he is guided by their matter and by the critico-historical views of Jaeger and Ross, outlined in a short Introduction by Sir David himself. He has added chapter titles, numbered sections, prefixing their main groups with a short summary of contents and has courageously kept clear the main line of Aristotle’s argument by relegating all parentheses to footnotes, to which he adds his own identification of historical references. Radical re-arrangement justifies itself by success—here a forbidding classic is presented with the immediate, systematic clarity of a modern text. (shrink)

Eleven Oxford dons and one guest-speaker from Melbourne in this candid series of talks, first delivered on the radio in 1955, seem to share a conscious disadvantage in respect of their subject, the irrepressible science of metaphysics—like a group of disconcerted bankers who return to trade with a one-time bankrupt, whose currency has irresistibly hardened again and for whom they now concert a limp welcome and a scratch set of trading rules. As Mr. Warnock wryly notes: “It would be impossible (...) to deny that respect or distaste for metaphysics is, though no doubt it should be an intellectual matter, in fact very largely a matter of temperament; and disagreements of this variety are notoriously liable to be heated and vehement, liable also to be long drawn out, inconclusive, and rather unprofitable”. After the eighteenth century bankruptcy proceedings instituted by David Hume and the subsequent doldrums of university philosophy, the empiricist suspicions of Victorian Britain led to the positivist hostility of the twentieth century towards that traditional, standard science, which Europe never substantially devalued. The current return in England is both a forced retreat from brash futility in the field of urgent values and of scientific postulates, and a cautious reconnaissance of old positions. The present exploratory discussion is not unlike an international truce in its tendency to bog down in procedural analysis and to substitute this new scholasticism for an engagement in the substantial business of metaphysics. Metametaphysics buries its head in sand of its own sophisticated creation; and the individual talks are not as distinct nor as simple as their titles might suggest. (shrink)

Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk.
